RELEASE AND WAIVER OF LIABILITY BY A MINOR

NOTICE – THIS IS A LEGAL DOCUMENT THAT CONTAINS A GENERAL RELEASE.
It should be read carefully and understood fully before signing.

This Release and Waiver of Liability by a Minor (this “Release”) is executed on this date by the below-named minor child (“Volunteer”), and the parent having legal custody and/or the legal guardian of Volunteer (“Guardian”) in favor of FULLY FURNISHED MINISTRIES, INC., a Georgia nonprofit corporation, its directors, officers, employees, volunteers and agents (collectively, “FFM”).

Volunteer and Guardian desire that Volunteer serve from time to time with FFM in the performance of FFM’s ministry activities, engaging in such activities as FFM may from time to time designate as relating to FFM’s ministry (hereinafter referred to collectively as “Volunteer’s Service”). Volunteer’s Service may include, without limitation, (1) handling, lifting and carrying household furniture and furnishings, both within FFM’s warehouse facility and within the homes of furniture donors and furniture recipients, (2) cleaning, repairing, restoring and refinishing furniture, (3) cleanup and general labor activities in FFM’s warehouse, sometimes using ladders, power tools or other implements, (4) loading and unloading furniture and furnishings onto and off of trucks or other vehicles, (5) traveling to and from locations where FFM performs ministry services, in FFM-provided vehicles or otherwise, and (6) such other activities as may be described from time to time on FFM’s website (fullyfurnishedministries.org) as being typical of FFM’s ministry.

Volunteer and Guardian do hereby freely, voluntarily and without duress execute this Release on and subject to the following terms:

1. Waiver and Release. Volunteer and Guardian hereby waive, release and forever discharge and hold harmless FFM and FFM’s successors and assigns from and against any and all liability, claims, actions, causes of action and demands of any kind or nature whatsoever, either at law or in equity, which now exist or may hereafter arise from or in connection with Volunteer’s Service with FFM, including specifically, but without limitation, claims relating to any property damage, bodily injury, personal injury, illness or death suffered by Volunteer or Guardian and resulting from or relating to Volunteer’s Service (collectively, the Released Claims); and Volunteer and Guardian hereby covenant and agree not to sue FFM in connection with or relating to any Released Claims. Volunteer and Guardian also understand and acknowledge that, except as FFM may otherwise agree in writing, FFM does not assume any responsibility or obligation to provide financial assistance or other assistance to Volunteer or Guarantor in the event of injury or illness, including but not limited to medical, health or disability insurance.

2. Medical Treatment. Except as FFM may otherwise agree in writing, and without limitation of any other waiver or release in this Release, Volunteer and Guardian hereby specifically release and forever discharge FFM from any claim whatsoever that arises or may hereafter arise on account of any first aid, treatment or service which may be rendered to Volunteer in connection with Volunteer’s Service with FFM, whether by any employee, officer, director or agent of FFM, or by any other volunteer, or by any other person or entity.

3. Assumption of the Risk. Volunteer and Guardian understand and acknowledge that certain activities comprising Volunteer’s Service may be inherently dangerous or hazardous to Volunteer, and Volunteer and Guardian hereby expressly and specifically assume the risk of injury or harm from such activities.

4. Insurance. Volunteer and Guardian understand and acknowledge that FFM does not carry or maintain health, medical or disability insurance coverage for any Volunteer. VOLUNTEER OR GUARDIAN ON BEHALF OF VOLUNTEER IS EXPECTED AND ENCOURAGED TO OBTAIN MEDICAL OR HEALTH INSURANCE COVERAGE FOR VOLUNTEER.

5. Governing Law. Volunteer and Guardian expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Georgia, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Georgia. Volunteer and Guardian agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.

I, the volunteer (the “Volunteer”), desire to provide voluntary services to NGF and engage in the activities related to being a Volunteer for NGF. I, the Volunteer, hereby freely and voluntarily, without duress, execute this Release under the following terms:

1. Volunteer’s Participation. I, the Volunteer will engage in activities for NGF or other tasks as requested from time to time by NGF (“Volunteer Activities”). NGF will provide on-going support and direction to Volunteer, as appropriate. In performing Volunteer Activities, Volunteer agrees that Volunteer is not an employee or agent of NGF and is not entitled to any compensation or benefits from NGF.

2. Waiver and Release. I, the Volunteer, hereby indemnify and hold harmless, and fully and forever release and discharge, NGF and its successors and assigns, from and against any and all claims, demands, actions, causes of action, liability, costs, damages or injury, whether known or unknown, foreseen or unforeseen, suspected or unsuspected, which arise or may hereafter arise from my volunteer work with NGF, including, without limitation, my involvement and participation in NGF programs, participants, and other NGF volunteers. I, the Volunteer, understand and acknowledge that this Release discharges NGF from any liability or claim that I may have against NGF with respect to bodily injury, personal injury, illness, death, or property damage that may result from participation in NGF activities. It is understood that NGF does not assume any responsibility for, and is under no obligation to indemnify me or provide any other remedy in the event of any claim, demand or action against me by or on behalf of any participant in NGF activities, any parent or guardian of a participant in NGF activities, or any organization or other entity providing services as part of NGF activities or otherwise on behalf of NGF, and my waiver and release described herein includes a full and complete waiver of any right or claim for any such indemnification or remedy. It is also understood that NGF does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance in the event of injury, illness, death or property damage. I, the Volunteer, understand that I expressly waive any claim for compensation from or liability on the part of NGF, including pursuant to its insurance policies. I, the Volunteer, having been afforded ample opportunity to consult with my counsel, also expressly agree and covenant not to sue or seek any other type of legal recourse against NGF for any matter I, the Volunteer, have released NGF from hereunder.

3. Conduct of Volunteer. Volunteer will perform Volunteer Activities in a manner that will serve to enhance and support the goals and mission of NGF. Volunteer agrees to comply with NGF’s rules, regulations, and policies in the NGF Volunteer Handbook, which Volunteer has received orally and/or physically and read, and as may be changed from time to time by NGF. Volunteer also agrees to comply with directions given by NGF. Volunteer will provide Volunteer Activities in a professional manner consistent with the highest standards of ethical and moral conduct. Volunteer warrants and represents that all information that Volunteer has provided to NGF regarding Volunteer’s background, experience and/or skills is true and accurate, and assumes responsibility for any and all claims, costs, damages, or liabilities that result from the provision of incomplete or inaccurate information. Volunteer also understands that, except as otherwise agreed to by a Released Party, as defined below, in writing, the Released Parties do not provide any financial assistance of any kind, including, but not limited to, workers’ compensation, medical, health or disability insurance coverage for any volunteer.

4. Medical Treatment. I, the Volunteer, certify that I am in good health. In case of illness or accident, permission is hereby granted for emergency treatment to be administered to me, at my cost, in the event that emergency treatment is necessary, but I understand that NGF has no duty to me to arrange for such emergency treatment (and if NGF does have such a duty to me, I hereby irrevocably release them from any such duty). I, the Volunteer, hereby release and forever discharge NGF from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my time with NGF. I understand and agree that I am responsible for all medical care expenses including, without limitation, physician, hospital, lab, drug and device expenses.

5. Assumption of Risk. As the Volunteer, I hereby expressly assume the risk of injury or harm in NGF activities and release NGF from all liability for injury, illness, death or property damage resulting from my participation in NGF activities. As the Volunteer, I understand that the Volunteer Activities may involve inherently dangerous risks, and potential exposure to employees, participants, other volunteers, or other individuals, including members of the public, who may be infected with communicable or otherwise dangerous diseases or other malady, including COVID-19, Volunteer hereby expressly and specifically assumes the risk of damage, injury, harm, or death in connection with such Volunteer Activities. Volunteer acknowledges and fully understands that Volunteer may be engaging in activities that involve risk of serious injury, including permanent disability, disfigurement or death, and severe social and economic losses might result not only from their own actions, inactions, or negligence, but the action, inaction or negligence of others, or the condition of the premises or equipment used.

6. Photographic Release. I hereby acknowledge that NGF and its Affiliates may photograph or film me during my participation in its activities and agree that any resulting film and/or photos may be edited, duplicated and used in whole or part throughout the United States of America, in NGF’s sole and absolute discretion, in accordance with all applicable laws. I acknowledge that NGF, and its successors and assigns, own all rights, title and interests in and to such films or photographs and hereby assign to NGF and its successors and assigns any and all rights, title and interests that I otherwise may have therein and thereto, on a worldwide, perpetual, non-exclusive, royalty free and sub-licensable basis.

7. Confidentiality. As the Volunteer, I hereby understand that it is the policy of NGF to ensure that the operations, activities, and affairs of NGF are kept confidential, unless the sharing of such information is approved in advance by an NGF staff member, or is otherwise required to be disclosed to a governmental authority by applicable law, or such disclosure to a governmental authority is otherwise protected by applicable law. Confidential information includes, but is not limited to, what is shared during any meetings and daily work activity, internal reporting, personal information about NGF’s clients, donors, volunteers, or employees, financial data, business information, and intellectual property. In consideration for the opportunity to work as a volunteer with NGF, Volunteer agrees to refrain, both during and after the end of the volunteer relationship, from repeating to any outside source and to keep confidential all information or records pertaining to NGF’s operations, clients, donors, volunteers, or employees obtained while doing Volunteer Activities. Volunteer understands that this is privileged information and is not to be shared with anyone other than a current employee of NGF, and then, only as necessary to properly carry out the Volunteer Activities. Volunteer acknowledges that any violation of confidentiality will result in disciplinary action which may include termination of Volunteer Activities, and that NGF may take legal action against Volunteer, including but not limited to seeking temporary restraining orders or permanent injunctions to prevent the disclosure of confidential information in federal or state courts in Georgia.

As the Volunteer, I expressly agree that this Release shall be governed by and interpreted in accordance with the laws of the State of Georgia, and is intended to be as broad and inclusive as permitted by the laws of the State of Georgia and the United States of America. As the Volunteer, I expressly agree that any civil action for judicial relief with respect to any dispute or matter whatsoever arising under, in connection with, or incident to, this Release shall be brought, if at all, in the State Courts of Forsyth County, Georgia or the federal courts seated in the County of Fulton, City of Atlanta, in the State of Georgia. I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release, which shall continue to be enforceable.

Thank you for serving No Longer Bound. Our mission is to rescue addicts, regenerate men and reconcile families. As a nonprofit, we do this work with the help of the community who supports us. We ask thrift store volunteers to adhere to the following guidelines:

1. No Longer Bound is not responsible for any lost, stolen, or damaged property while serving. Please make sure to secure your valuables before you begin work.

2. If you are attempting a task that feels beyond your physical capabilities, please notify staff immediately to avoid injury.

3. If an injury is sustained at any time, please notify staff immediately.

4. Purchase Policy: If you see an item in the back you wish you purchase, it must go out on the sales floor and be there for 24 hours before it can be purchased by staff or volunteers.

5. Confidentiality Policy: If you work together with residents from our program, we ask to observe the following confidentiality guidelines:
• Volunteers agree no photos of residents will be taken or posted on the Internet.
• Volunteers agree not to discuss residents once leaving the site. Who you see in our program must remain confidential.
• Volunteers agree not to solicit personal/private information from residents.

6. We reserve the right to terminate volunteers with our organization at any time without expressed reason.

7. I hereby grant the releasee permission to use photographs in any of the following: Web-based publications, Print Advertisements and Organization Bulletin. I hereby affirm that such release to the release does not constitute any form of compensation, including royalties arising from the photographs, to my benefit.

VOLUNTEER SERVICES RELEASE (ADULT 18 AND OVER)

Whereas the undersigned wishes to participate in and aid The Salvation Army in rendering service, and The Volunteer wishes to accompany other volunteers under the direction of The Salvation Army to various locations.

Now, therefore, in consideration of The Salvation Army allowing The Volunteer to participate in and aid The Salvation Army, and its clients, in rendering service in various departments and allowing The Volunteer to accompany other volunteers under the direction of The Salvation Army to their respective locations. The Volunteer agrees as follows:

(1) The Volunteer is participating in and aiding The Salvation Army in rendering service to various locations and is accompanying other volunteers to various locations entirely upon the initiative of The Volunteer and The Volunteer assumes all risk associated with rendering such aid. The Volunteer understands and is aware of the risk associated therewith and voluntarily assumes such risk.

(2) The Volunteer does hereby forever indemnify, defend and hold harmless The Salvation Army and all of its officers, agents and employees, acting officially or otherwise, from any litigation, causes of action, damages, costs, and expenses of every kind and character (including reasonable attorney’s fees) for, on account of, or in connection with, any personal injury, damages, or loss of any kind or character to person or property suffered or occasioned by The Volunteer whether or not caused by or resulting from the negligence of The Salvation Army or any of its officers, agents, and employees, acting officially or otherwise, in connection with or with regard to rendering of services by The Volunteer to various locations.

The Volunteer does hereby, for himself or herself, his or hers, executors, administrators and assigns, release, remise, and forever discharge The Salvation Army and all of its officers, agents and employees, acting officially or otherwise, from any and all claims, demands, losses, actions or causes of such action, liabilities, litigation cost, and expenses of every kind and character (including reasonable attorney’s fees) on account of the death of The Volunteer during, with regard to, or in connection with the rendering of such services by The Salvation Army.

CONFIDENTIALITY COMMITMENT
Acknowledging that Federal law protects client confidentiality, I agree to respect the complete confidentiality and privacy of any client whom I might see, talk with or have any contact with while in this facility. I will not divulge information regarding any person, including clients, staff, interns and/or individuals within the program, without receiving prior written consent from the individual to do so. Further, I understand the corps officer/unit administrator or his/her designated staff must be notified immediately if a court order is served to a current or former staff member, volunteer, Board member or student intern regarding any program records or activities, residents, nonresidents, shelter center activities or personnel policies.

PHOTOGRAPHY RELEASE
I hereby irrevocably grant to The Salvation Army the absolute right and permission to copyright and/or publish to use photographic portraits or pictures of me, or in which I may be included in whole or in part, or composite, or distorted in character or form, in conjunction with my name or a fictitious name, or reproductions thereof in color or otherwise, made through any media, for art, advertising, or any other lawful purpose whatsoever. I also grant The Salvation Army the same right and permission to use any statements or testimonials made by me.
